Black Man Dies After K9 Bites Him During Arrest In Tennessee
The cause of death is not yet known. Still, a legal expert is weighing in on the use of force as the Clarksville Police Department and the Tennessee Bureau of Investigation investigate the incident.
We spoke to criminal defense attorney Ben Raybin, who watched the viral video of the arrest involving the K-9 that bit Darius Chappell for nearly a minute.
He said he believes police used excessive force.
Video from a bystander shows several law enforcement officers struggling to arrest Chappell on Fort Campbell Boulevard.
According to the affidavit of complaint, officers tased him numerous times.
A Clarksville police officer released a K-9 on Chappell while he was on the ground. The dog appears to bite him for 59 seconds.
Defense attorney Ben Raybin has expertise in cases involving police dog bites.
"This could very potentially be an excessive use of force," Raybin said.
Raybin said officers have to take several things into account, including the crime the person is accused of, whether they are resisting arrest and the circumstances of the moment.
Court records show Chappell had a felony warrant for violating parole and had previously fled from police on Fort Campbell Boulevard by running "into oncoming traffic."
After the altercation and police dog bite, the Montgomery County Sheriff's Office said Chappell was taken to the hospital and then medically cleared before being booked into the Montgomery County Jail.
Chappell was charged with parole violation, assault against a first responder, resisting arrest, and evading arrest.
Four days later, Chappell died.

According to the arrest report, deputies saw a white Chevrolet Tahoe parked at the Burger King on Fort Campbell Boulevard at about 11:30 a.m. on June 29. Investigators said the registered owner, Darius Chappell, had an active felony warrant for violation of parole.
Chappell was seen leaving the Burger King and began running when deputies tried to stop him, according to the arrest report. Deputies used their emergency lights and sirens, but said Chappell kept running into oncoming traffic on Fort Campbell Boulevard.
Deputies said they used a taser on Chappell multiple times, but he did not stop fighting back. The arrest report said Chappell grabbed a deputy’s vest near the throat and pulled the deputy.
Following his arrest, Chappell was transported to Vanderbilt of Clarksville Hospital, where he was evaluated, treated, and medically cleared for booking into the Montgomery County Jail. Upon his arrival at the jail, he was processed and booked in. Our jail medical staff conducted their own medical assessment, and Chappell continued to receive medical care in accordance with established jail medical protocols.
