Flagler County, FL - On Thursday, April 16, at 8:50 p.m., Deputy Wilkinson detected a strong odor of alcohol, slurred speech/thick tongue, and watery eyes during a traffic stop. The driver, David Stewart, 36, of St. Augustine, immediately defensive and confused about the violations, repeatedly asking if everything was on video (good news: it was).
When asked for registration and proof of insurance, Stewart reportedly produced an envelope labeled “Title.” He then asked a series of nonsensible questions like “Am I allowed to dig?”, and when the deputy asked to read the registration (which was upside down), Stewart replied: “No you have a camera on your f***ing ass,” which is in fact not where deputies place their body cameras.
After refusing multiple lawful commands (including being told six times to move to the front of the patrol vehicle) and physically tensing and resisting when the deputy attempted to handcuff him, Stewart was arrested for Resisting Law Enforcement Without Violence and DUI.
While en route to jail, Stewart screamed, kicked the window/roof/partition and was so unruly that the deputy upgraded response to the Sheriff Perry Hall Inmate Detention Facility with lights and sirens activated—which is extremely uncommon and was done due to Stewart’s behavior presenting a safety concerns.
At the Sheriff Perry Hall Inmate Detention Facility, Stewart provided breath samples of: 0.170 BAC 0.169 BAC.
Stewart later claimed he “only had one beer.” Sure. One beer. One VERY large beer.
Stewart was charged with DUI and obstruction without violence, because no sheriff’s cars or feelings were harmed in the making of this video.
"People see the video and laugh, but this is the reality our deputies face when someone chooses to get behind the wheel drunk. It's dangerous, unpredictable, and it puts everyone at risk," said Flagler County Sheriff Rick Staly. "If you drive impaired in Flagler County, we will stop you, we will arrest you, and we will take you to jail, kicking and screaming."
Bottom line: If you drink, don’t drive. And if you get stopped, don’t turn it into temper tantrum—because the Green Roof Inn always has availability for people who insist on learning the hard way.
