Police have released video from a 2024 incident in which former Patriots player Patrick Pass allegedly assaulted an 82-year-old man at a gym in North Providence.

Pass is accused of pushing the man during an argument at the Planet Fitness on Mineral Spring Avenue on Aug. 28, 2024. He was arrested the following month and charged with assault on a person over 60 causing bodily injury and disorderly conduct.

During a hearing Thursday, the court ordered Pass to enter a diversion program geared toward rehabilitation, rather than proceeding with criminal prosecution.

North Providence Police Chief Alfredo Ruggiero Jr. said he felt the department brought a strong enough case for charges, but the court reached a different conclusion.

“Our department did our due diligence and presented all of the information, but the outcome is not what we had hoped for,” Chief Alfredo Ruggiero Jr. told 12 News during a phone interview.

As a result, the department released surveillance footage of the incident to the public for the first time.

The video shows the victim spraying and wiping down an apparently vacant exercise machine. Police said they were unable to obtain audio, but Pass can be seen shoving the man to the ground after an exchange of words. The victim reportedly fell back onto a piece of equipment, striking his back and rib area.

“I held off quite a while. I didn’t want to taint with the video what was taking place in the court system,” Ruggiero said. “We are very confident with the charges we originally brought against him.”

Pass’s attorney, Craig Montecalvo, released a statement to 12 News saying he believes the court’s decision was “perfectly appropriate.”

“It’s been my absolute pleasure representing Patrick,” the statement said. “He’s an asset to his community. He’s a responsible law-abiding member of his town and society. He’s never been in any trouble. And the way this case has been resolved has been perfectly appropriate given all the circumstances.”

“I would respectfully disagree,” Ruggiero said in response to the statement.

He added that the victim was disappointed after being notified of the court’s decision.
