New body camera video shows the moment Oklahoma Secretary of State Benjamin Lepak was arrested at a McDonald’s on suspicion of public intoxication.

Lepak was arrested in Edmond on Friday.

According to court documents, the Edmond Police Department was called to a McDonald’s around 10:45 p.m. for a report of a man drunk in public.

When officers arrived, they said they saw Lepak standing at the drive-thru window. Officers saw Lepak’s vehicle in the parking lot, which he reportedly confirmed was his.
According to the arrest affidavit, one of the officers said Lepak had “extremely slurred speech” and an “odor of an alcoholic beverage coming from his breath.” When officers asked Lepak to show his ID, he reportedly struggled to remove it from his wallet.

An officer asked Lepak where he had been, to which he responded that he had gone to church earlier. During the conversation, the officer continued to ask him what he had been doing and asked why he was unsteady on his feet, why his speech was slurred and how much he had had to drink. Lepak argued that he was not unsteady on his feet and said he had been at church with other fathers for a gathering.

Officers said Lepak was unable to maintain a “coherent train of thought” during their conversation.

Lepak said he had been at a church event and admitted to having a beer.

The affidavit said Lepak admitted “I had a beer… that’s it,” then backtracked and said he had less than one beer because he did not finish it.

Police said Lepak continued to make contradictory statements about driving to the McDonald’s and how he got there.

Officers placed Lepak under arrest on suspicion of public intoxication.

Attorney general calls for firing
Following news of Lepak’s arrest, Oklahoma Attorney General Gentner Drummond called for the secretary of state’s immediate firing.

“After reviewing footage from law enforcement body cameras, it is clear that Secretary of State Ben Lepak was thoroughly inebriated and very likely lied to law enforcement about how much he had to drink and how he and his car both arrived at the same place without him driving it. This conduct is thoroughly unbecoming of a such a high ranking state official, and I am demanding that Gov. Stitt fire him immediately,” Drummond said.

Lepak was appointed by Oklahoma Gov. Kevin Stitt in October 2025 to serve as interim secretary of state before fully taking over the position in January 2025.

Stitt has not yet commented on the incident.

It is not the first time Lepak has faced charges related to alcohol. He was charged with a DUI in May 2021.
