A Florida man was arrested Saturday after deputies say he shot at a sheriff’s office drone that was being used as a first responder during a call.

The Lee County Sheriff’s Office says its Drone As First Responder program was deployed in the area of Todd Avenue S in Lehigh Acres to assist with an ongoing incident.

While monitoring the scene, the drone operator observed several males carrying what appeared to be a firearm. Moments later, one of the individuals identified as Elvin Antonio Callejas-Serrato allegedly pointed the weapon at the drone and fired two rounds.

Deputies who were already in the area quickly moved in and detained the group.

During the investigation, authorities say they recovered a BB rifle loaded with steel projectiles.

Callejas-Serrato was arrested and charged with shooting or throwing deadly missiles into an aircraft.

Sheriff Carmine Marceno praised the drone program, saying it is designed to improve response times and enhance safety for both deputies and the community.

@Gutshot I don't know about inaccurate. I have a .22 caliber pellet rifle and it's accurate enough to headshot a rabbit at 40 yards at least. That's the longest straight line of sight on my small property, and that's a pretty small target. It's also powerful enough to go through a target paper, a sheet of cardboard, 1/2" bc plywood, 1/2" sheetrock, spun glass insulation, and a sheet of T-111.

@deadtedw Yup, under federal law, drones are considered aircraft, and shooting at one is treated as a federal offense. The FAA classifies drones, regardless of size, as part of the U.S. national airspace system, and damaging one is no different than sabotaging an airplane.

Title 18 U.S. Code § 32, known as the Aircraft Sabotaging Act, makes it a crime to “set fire to, damage, destroy, disable, or wreck any aircraft.” This includes drones, which are specifically listed under the FAA’s interpretation of aircraft. Even if the drone appears to be invading your privacy, discharging a weapon at it is illegal and can result in serious criminal charges, including prison time and substantial civil penalties.
