In June 2023, Judge Poland received a public censure from the Tennessee Supreme Court due to misconduct during his time as an attorney. The censure was a result of several violations of the Rules of Professional Conduct, which included:
Lack of Diligence: Failing to act promptly on behalf of a client.
Poor Communication: Not responding to messages from opposing counsel or his client.
Misrepresentation: Providing false assurances to his client regarding actions he would take.
As part of the censure, he was also required to pay costs and fees associated with the Board of Professional Responsibility.
