Off-duty NYPD officer in a Jeep Gladiator fatally struck woman in Jackson Heights Newly Released Video Shows

New York Attorney General Letitia James’ Office of Special Investigations (OSI) launched a probe into a Jackson Heights fatal collision that killed a woman just steps from her home last month after it was determined that the driver of the vehicle was an off-duty NYPD officer.

On Saturday, April 25, Alba Giraldo, 67, of 92nd Street in Jackson Heights, was walking home just after 8:45 p.m. and crossing 32nd Avenue in a marked crosswalk when a 27-year-old man driving a 2020 Jeep Gladiator traveling westbound on 32nd Avenue made a left-hand turn onto 92nd Street, where he struck the elderly woman. Police from the 115th Precinct a block from the scene responded and found Giraldo lying on the roadway with severe head trauma. She was rushed by EMS to Elmhurst Hospital, where she was listed in critical condition.

The off-duty cop who was behind the wheel of the Jeep remained on the scene and was later transported by EMS to New York-Presbyterian Queens Hospital in Flushing, where he was listed in stable condition. An NYPD spokesman could not say if the off-duty cop was assigned to the 115th Precinct. Giraldo succumbed to her injuries and was pronounced dead on Thursday, April 28. There are no arrests and the investigation remains ongoing by the NYPD’s Highway District Collision Investigation Squad

OSI started its own investigation into the case of May 1, pursuant to New York State Law Section 70-b. OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident.

67? Looked like over 80. She's walking was better than his real age though. Anyway, mostly her fault she stepped on the zebra crossing when the light was already blinking. The driver's fault that he stopped on the zebra crossing, not before that.

Wrong. A driver is legally at fault for hitting a pedestrian who is already in the crosswalk, regardless of whether the light turned green for the vehicle (which in this case was red). Drivers are legally obligated to exercise due care and yield to anyone clearing the intersection before proceeding...

@APieceOFGarbage That old lady should not even have been on the crosswalk, because the light was blinking for pedestrians, when she arrived there. If pedestrians are already on the crosswalk, they can finish walking through ASAP, but cannot step on the crosswalk from the sidewalk, if they arrive there after pedestrian lights go blinking.

Also, I didn't write that the driver was without fault, just the one who added most to this accident was clearly the pedestrian.
