ALERT: Mayor arrested after a heated city council meeting led to him allegedly assaulting an elderly man in Texas.

Balcones Heights Mayor Johnny Rodriguez got into a heated argument over the budget and even called for a member to be removed.

78-year-old Lamar Gillian, a former city council member, told Rodriguez, "Don't you touch me," as Rodriguez made contact with his shoulder on his way out of the door.

Investigators say Gillian was not blocking Rodriguez’s path out of the door, and it appeared he was making another movement towards Gillian before a bailiff stepped between them.

Rodriguez, whose charge is a class A misdemeanor because Gillian is over 65, was released from jail on a $5,000 bond.
