ALERT: High school football player dies after “textbook tackle” left him with a traumatic brain injury, and the family is suing the school district.
16-year-old Christopher Garcia was playing in a football game in Los Angeles when a tackle led to him hitting his head on the ground.
Christopher suffered a traumatic brain injury and underwent emergency medical treatment, but died 11 days later.
Attorney Michael P. Hernandez, the Garcia family’s lawyer, is arguing on their behalf that the “primary assumption of risk” doesn't apply to the poor conditions of the field.
“California follows a doctrine called primary assumption of risk. A player who steps onto a football field accepts the risks that are inherent to the sport itself.”
“A hard, poorly maintained surface is not an inherent risk of football. It is a maintenance and safety failure.”
The lawsuit against the LAUSD failed to demonstrate that it “provides safe facilities, proper equipment, and adequate supervision.”

We're way over lawyered. Next go around, we should make it illegal to be a professional lawyer. This will necessitate simple laws that normal people can understand. They deliberately write completely unnecessary complexity into the law as make work. The lawmakers themselves are mostly lawyers.

The are risk in everything except a padded loonie bird cell. I know that the family is grieving but that is a full contact sport. There is a 100% chance you are going to get injured someway or another. You had to sign a permission for him to play, knowing full well those risks.
