This is happening in Jacksonville, Florida at a 55+ community. A 28-year-old girl was living there with her father who was ill when he passed. He gave the home to his daughter, and she wants to remain living in the community.. well the HOA has decided to enforce the 55 and over law, and is asking for $1000 from 155 members in the community to sue her to get her out of the neighborhood because she’s 28 years old, not 55+. In my opinion, this is despicable. These HOA‘s have way too much power. This sh!t has to stop.

I would have to see the contract language that was agreed to when the father purchased the home. There must be some sort of transfer clause that can be enforced. As for the chick, you have a tax free profit from the inheritance. Sell the house and go live with people your own age.

People don't know they can refuse to sign the HOA.

I used to do house sales closings for a title company.

We were told, rightfully so, as it isn't an notaries' place, that we were never to inform anyone of that. ( among other things)

Most just signed, but I did a few that wouldn't. Of course no real estate agent would say anything to stop the sale, but some sellers would get worried the sale couldn't be recorded, thinking in error that tge HOA had a lien interest.

if you buy a home in an established HOA neighborhood, agreeing to the covenants and paying dues is mandatory to complete the purchase. However, if an HOA is formed after you already own your home, joining is usually optional. HOAs most definitely have a lien interest and can file one against a property with dues owed and in default.
