(1) Does the city owe him a duty of care? Yes. They owe a duty of care towards pedestrians. They are in law 'neighbors'.
(2) Did the city breach its duty of care by leaving bolts exposed? In other words, would a reasonable person think a pedestrian tripping over exposed bolts and suffering an injury was reasonably foreseeable? I would say it is readily foreseeable that someone could fall over exposed bolts, especially an old infirm pedestrian.
(3) Did the breach of its duty by the city cause the plaintiff his loss? We have video evidence that he fell over the exposed bolts and struck the car. Unless those were preexisting injuries, the city's breach of its duty of care caused the fractures to the neck and back. ![]()
