He put himself in front of her car clearly knowing she would drive forward. He drew his gun before she even put the car in drive. He could have stepped away but he chose murder. Murder should always be the last resort not the first. If anyone one else was in front of a car that was going to drive forward they would have just moved not kill the driver. He knew he was going to shoot her all along. This was premeditated.
