Police Report: North Wildwood, NJ On the above date and time I observed a black car traveling at a high rate of speed north bound. I confirmed the vehicle was traveling over the posted speed limit of 25 mph with my RADAR, which showed the vehicle to be traveling 37 mph. I approached the vehicle and spoke with the driver, later identified as Calista, I observed her to be holding her phone, speaking on speaker phone to a male. I requested Calista's documents and noticed her movements to be slow. I also observed a strong odor of alcoholic beverages emanating from her breath. Calista stated she had two drinks at the bar. Calista attempted to present her insurance on her phone, but was having issues with logging into the phone. The first test I administered was the Horizontal Gaze Nystagmus. I utilized my pen as a stimulus and checked for equal pupil size and equal tracking in both eyes. I observed distinct and sustained nystagmus in both of Calista's eyes, and at maximum deviation. I observed nystagmus in both eyes prior to 45 degrees. I did not observe vertical gaze nystagmus. The next test I administered was the walk and turn. I demonstrated and explained the instructions and ensured Calista understood them. She stated she had no medical issues with her feet or legs. Calista was unable to get in the starting position without losing her balance. Calista did not touch her toe to her heel, did not count her steps out loud, did not keep her arms at her side, and took more than 9 steps in each direction. The next test I administered was the one leg stand. I demonstrated and explained the test to Calista. Calista raised her right foot off the ground but bent her arms holding her hips, did not watch her foot, and did not count out loud as I had instructed. Calista had to put her foot down after approximately 4 seconds in order to keep her balance. Calista continued the test by raising her right foot again, but put her hands on her hips and did not watch her foot. On Calista's count of "6" she had to put her foot down again in order to keep her balance. I then placed Calista under arrest. Calista became argumentative, refusing to get in the car without her phone. I then searched the vehicle for intoxicants, which I did not locate. Calista's vehicle was impounded as per John's Law. While Calista was in my patrol car I detected the odor of alcoholic beverage coming from the rear of the vehicle which I did not detect prior to Calista being in the vehicle. Calista requested a breathalyzer and for her vehicle not to be towed. I collected 5 breath samples from Calista, 2 of which were accepted, which produced a blood alcohol content of .16%. She was charged with the following: 39:4-50: Driving while intoxicated 39:4-98: Exceeding maximum speed 1-14 mph over limit 39:4-88: Unsafe Lane Change 39:4
