Around 10:43 PM on October 12, 2022, Vineland Police dispatch received a 911 transfer from the State Police advising them of an erratic driver within their jurisdiction. The 911 caller had followed the 2018 Honda Civic from where it had collided with the guard rail on Route 55.
Officer Jeffrey Rowan noticed that the vehicle ultimately had stopped on North East Avenue just north of East Park Avenue and the caller confirmed at the scene that she was the person they had called to report. Officer Rowan proceeded to make contact with the driver, who was identified as 24-year-old Sierra Rule. As he began to interact with the driver, he noticed that her speech was slurred and he detected the odor of alcohol in the vehicle. Shortly afterwards, Officers John Rizzo and Amariel Perez arrived on scene shortly afterwards to assist. Officer Perez questioned Sierra about the damages to her vehicle and where she was coming from. Sierra told Officer Perez that she was coming from the Playhouse Lounge in Burlington, NJ, where she worked as a dancer. While she initially denied consuming alcohol, she eventually admitted to consuming wine in the hours prior.
As the officers were conducting their investigation and coordinating with the State Police, Sierra repeatedly stated that she needed to use the restroom. Based on their suspicion of impairment, the officers offered Sierra an opportunity to participate in field sobriety exercises. Since Sierra continued to state that she needed to use the restroom, they received approval from a Sergeant to conduct the field sobriety exercise at police headquarters instead. Officer Perez transported Sierra to the Vineland Police Department, where she was given an opportunity to use the restroom. After Sierra used the restroom, Officer Christian Morales started the field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test, and Officer Morales noticed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The second exercise was the Walk and Turn test. During the Walk and Turn test, Sierra did not walk heel-to-toe in a straight line, used her arms for balance, and took an incorrect number of steps. The third exercise was the One Leg Stand test, and Sierra failed to raise her foot in the proper fashion or count in the proper sequence. Based on her slurred speech, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Sierra was restrained to the bench for driving under the influence. After Officer Morales completed a 20-minute observation period, he read Sherra the Standard Statement for Motor Vehicle Operators along with her Miranda rights. Sierra agreed to submit breath samples for testing. Her Alcotest results indicated a BAC of 0.13%, which is more than the legal limit of 0.08%. After Sierra was booked and processed, she was released to a responsible party pending her court appearance after they signed the Potential Liability Warning form on her behalf. Sergeant Smith issued her the following summonses: Operating under the influence and reckless driving Court records indicate that on June 15, 2023, the DWI citation was dismissed based on prosecutorial discretion.
As part of her plea agreement, Sierra pleaded guilty to the reckless driving citation instead and she was subjected to $240 in fines along with a 45-day license revocation. -----
