The HOA contends this one is on common area property, but the homeowners, now facing a $100 fine, disagree” “The HOA has told you it would be okay if you flew the flag on your back patio” “The residents are now fundraising on GoFundMe to pay for an attorney to defend them” I found it’s The Ambiance Owners Association in San Marcos, California I want to make something very clear, a HOA cannot restrict you from flying a standard American Flag out front, this is protected and they will lose Federal and California law strongly protect this right Federal Law (Freedom to Display the American Flag Act of 2005): HOAs cannot prohibit or restrict the display of the US flag on residential property where the owner has a separate ownership interest or exclusive use. They can impose reasonable time/place/manner rules (e.g., size, how it’s mounted, proper etiquette), but not an outright ban California Law (Civil Code § 4705): Explicitly allows display of the US flag (fabric/cloth/paper) on separate property or exclusive-use common areas. HOAs cannot limit or ban it except for public health/safety reasons.
